We publish the proposals of the Administrative Law Crisis Cabinet Fide

"We are pleased to publish the final proposals of the Crisis Cabinet of Fide of Administrative Law. The group has met throughout the months of April and May to analyze different areas of law and publish a total of 12 proposals."

Last April, after the declaration of the state of alarm, Fide launched this Administrative Law Crisis Cabinet, with the aim of analyzing the problems and needs in the framework of administrative contracting in this emergency situation.

The Cabinet is led by Alberto Palomar Olmeda, Lawyer in the Administrative Law Area at Broseta Abogados. Full Professor of Administrative Law (Accredited by ANECA), Carlos III University of Madrid. Contentious-administrative magistrate. Member of the Academic Council of FIDE and in it we have professionals from the field, coming from offices, companies, academia and the Public Administration in its broadest sense.

We have structured the analysis of the essential topics in 3 blocks, we indicate below the topics submitted for debate in each of the blocks. As a result of this analysis, the members of the Cabinet have prepared 12 proposals.

  • The legal system and the pandemic
    • Reserve of law, system of sources and normative hierarchy in the state of alarm.
  • The operation and administrative action.
    • Administrative contracting in the pandemic situation and the rest of the administrative action.
  • Essential elements of reconstruction. The aid and subsidies. o The state of alarm and subsidies: analysis of the situation and proposals for action.
    • Financial aspects of contracting and provision of needs.
