The Global Digital Encounters have formed an Academic Faculty and Family of Speakers and Moderators, composed of worldwide known Academics and IP Senior Specialists from all continents. This Faculty and Family is constantly growing.

The long awaited Unitary Patent Court (UPC) system entered into force on 1 June 2023: this new supranational court allows the proprietors of Unitary Patents and classic European patents to enforce their rights – and third parties to have patents revoked – in all EU Member States having ratified the UPC Agreement, puts an end to the need for litigation before national courts in different countries and aims at enhancing legal certainty through harmonized case law in the area of patent infringement and validity. A few months have elapsed since the system is actually working. Which conclusions can be drawn from its existence, initial functioning and operations, and market reactions to the UPC? For this Session of our 32 Global Digital Encounters, authoritative speakers from Europe with a variety of backgrounds and opinions will provide a live picture of the present and future of UPC in favor of both business and consumers/society.

Rian KALDEN (The Netherlands)
Rian Kalden graduated at Leiden University and finished a Master (including Intellectual and Industrial Property law at LSE) at Londen University. She started her career joining the Amsterdam Bar with the law firm Stibbe, where she practised for almost 11 years. There she first joined the intellectual property department and turned to company law (focussing on mergers and acquisitions) later on.
In 2002 she was appointed judge at the District Court of The Hague, where she joined the Patent Chamber. After a short period in the criminal division at the District Court of Haarlem, where she was appointed Vice President in 2007, she returned to the Intellectual Property Division of the District Court of The Hague mid-2008, from 2009 as head of the Division, where she dealt with all kinds of IP cases, but mainly patent cases.
In September 2013 Rian Kalden was appointed judge in The Court of Appeal of The Hague. She headed the Division that also covers all IP cases for 5 years and as a Senior Judge she primarily dealt with patent cases until she left the The Hague Appeal Court in September 2023 to become a full time UPC judge.
In July 2018 Rian Kalden was appointed Judge at the Benelux Court of Justice, where appeals from decisions of the Benelux trademark offices are heard. In 2023 she resigned, in view of her appointment as legally qualified judge at the Court of Appeal of the Unified Patent Court as from June 2023, where she is Presiding Judge of the second panel. Rian Kalden is also member of the Presidium of the UPC. She regularly speaks at national and international conferences on Patent law and related issues.
Kevin MOONEY (UK)
Kevin specialises in contentious and non-contentious intellectual property matters, focusing specifically on patent litigation, especially in the pharmaceutical industry.
Kevin is recommended by “Chambers Guide to the Legal Profession”; cited by peers as “the doyen of patent law”. He is a past-President and a current member of the Advisory Board of the European Patent Lawyers Association (EPLAW). He has chaired three Venice conferences of the European Patent Judges.
He was Chairman of the Drafting Committee for the Rules of Procedure for the Unified Patent Court (“UPC”) and currently assists in the implementation of the Case Management System for the Court.
In March 2015, Kevin was awarded the Managing Intellectual Property Outstanding Achievement Award.
Mihály FICSOR (Hungary)
Former member of the EPO’s Administrative Council and Chairperson of the Committee on Patent Law, is now Principal Director for Legal Affairs in the EPO’s Directorate General of Legal and International and Affairs.
Prior to joining the EPO in 2020, Mihály Ficsor worked as Vice-President of the Hungarian Intellectual Property Office (HIPO) until 2016 and at the European Union Intellectual Property Office (EUIPO) in charge of European Cooperation and later as Head of Cabinet (2017 to 2020).
Emmanuel GOUGÉ (France)
Lawyer at the Paris Bar & Solicitor of England and Wales, Partner at Pinsent Masons. Director of the University Diploma in Patent Litigation in Europe at CEIPI. Emmanuel Gougé is a renowned counsel and litigator in IP law, with a strong focus on patents, trade secrets and trademarks. Emmanuel has been involved in a range of multi-jurisdictional IP matters. His practice focuses mainly on electronics, automotive, aerospace, life sciences, and medical devices. Emmanuel has been involved in a wide range of cross-border litigations and has played an instrumental role in advising clients on multi-jurisdictional matters.
